The decision of the Federal Court of Justice (BGH) on January 10, 2024, 2 StR 171/23, deals with difficulties in the interpretation and application of §§ 100a et seq. of the Code of Criminal Procedure. It is discussed that the legal provisions for the covert collection of data are inadequate following constitutional court rulings. A specific example concerns the retrograde collection of location data within the framework of a cell tower query according to § 100g para. 3 sentence 1 StPO, where the legal regulation is unclear. The decision of the BGH emphasizes the necessity of a uniform reform of the regulations on data surveillance. [Extracted from the article] |

Der Beschluss des BGH vom 10. Januar 2024, 2 StR 171/23, behandelt Schwierigkeiten bei der Auslegung und Anwendung der §§ 100 a ff. der Strafprozessordnung. Es wird diskutiert, dass die gesetzlichen Vorschriften zur heimlichen Erhebung von Daten nach verfassungsgerichtlichen Urteilen unzureichend sind. Ein konkretes Beispiel betrifft die retrograde Erhebung von Standortdaten im Rahmen einer Funkzellenabfrage nach § 100 g Abs. 3 S. 1 StPO, bei der die gesetzliche Regelung unklar ist.
